Reseña del editor Este estudio de Gabriel Sira Santana tiene por objeto analizar en tres partes el derecho de excepción venezolano a la luz de la Constitución venezolana de 1999 y sus implicaciones en la práctica.En el primer capítulo, el autor repasa los antecedentes constitucionales de esta figura y las definiciones planteadas por la doctrina nacional e internacional, para luego analizar su tipología, principios, controles y cómo opera la restricción de garantías en un estado de excepción según el ordenamiento jurídico interno y los tratados internacionales en la materia.Luego de esta aproximación teórica al régimen de excepción, en los capítulos siguientes el autor analiza cómo se implementó esta figura en la frontera colombo-venezolana desde finales del año 2015 –mediante ocho decretos de excepción que fueron prorrogados en su totalidad– y en todo el territorio nacional desde inicios del año 2016 –a través de cuatro decretos de excepción, tres de ellos prorrogados a la fecha de cierre del estudio–, precisando en todos los casos el contenido de los decretos, el control –o falta de él– por parte de la Asamblea Nacional y la Sala Constitucional del Tribunal Supremo de Justicia, las prórrogas acordadas y los decretos que se dictaron invocando el derecho de excepción, en la mayoría de las veces de forma innecesaria.Finalmente, la obra incluye un anexo en el que se enlistan los actos publicados en la Gaceta Oficial de la República que guardan relación con los estados de excepción señalados.Tapa blanda=364 páginas.
